Terms and Conditions

1. Definitions

  • “Carrier” – Refers to CHS Transport.
  • “Customer” – The person or business that contracts CHS Transport for its services.
  • “Conditions” – These terms and conditions, which govern the contract between the Customer and the Carrier.
  • “Consignee” – The person or entity to whom the Carrier delivers the goods.
  • “Consignment” – Goods or property, whether in parcels, packages, containers, or envelopes, transported by CHS Transport for the Customer.
  • “Dangerous Goods” – Items that include but are not limited to explosives, hazardous materials, radioactive substances, weapons, drugs, poisons, or any goods likely to cause harm, attract pests, or create a health hazard, as determined by CHS Transport.
  • “Storage” – The safekeeping and handling of goods, including loading, unloading, and movement between storage locations.

2. General Conditions

2.1 Service Provision – CHS Transport is not a common carrier and retains the right to accept or decline consignments at its sole discretion. These terms exclusively apply to all services provided by the Carrier. Any alternative terms proposed by the Customer will not apply unless expressly agreed in writing by an authorized director of CHS Transport.

2.2 Fair Terms – The Customer acknowledges that CHS Transport’s liability limitations are reasonable, considering that alternative carriers are available.

2.3 Customer’s Authority – The Customer confirms that they either own the goods being transported or have the authority to accept these terms on the owner’s behalf.

3. Dangerous Goods

3.1 The Customer must declare any Dangerous Goods before booking transport. CHS Transport reserves the right to refuse transport of such goods unless agreed in writing.

3.2 If accepted, all Dangerous Goods must be correctly classified, packed, and labeled per legal regulations, and the Customer must provide all necessary documentation.

4. Delivery

4.1 The Customer is responsible for ensuring that consignments are properly packed, labeled, and fit for transport by road, air, rail, or sea.

4.2 While CHS Transport will make every effort to meet agreed delivery times, these are estimates only. Time is not of the essence unless explicitly agreed in writing.

4.3 Unless otherwise agreed:

  • CHS Transport is not responsible for providing additional labor or special equipment for loading/unloading beyond what is on the Carrier’s vehicle.
  • The Customer must ensure any required special equipment is available at collection and delivery points. If CHS Transport is instructed to load/unload without such equipment, the Customer assumes full responsibility for any resulting damage.

5. Consignment Notes

5.1 If requested, CHS Transport may sign a document acknowledging receipt of goods, but this does not confirm their condition or weight.

5.2 The Carrier may require acknowledgment upon delivery, which shall be considered final proof of successful delivery.

6. Transit Terms

6.1 Transit begins when CHS Transport takes possession of the goods at collection.

6.2 Transit ends when the goods are delivered to the Consignee’s usual delivery location.

6.3 If delivery cannot be completed and the consignment remains undelivered for 48 hours (or a different agreed timeframe), transit is considered ended. Additional charges may apply for storage or redelivery attempts.

6.4 The Carrier reserves the right to recover expenses related to failed delivery attempts.

7. Governing Law & Jurisdiction

All contracts with CHS Transport are governed by English law, and any disputes fall under the exclusive jurisdiction of the English courts.

8. Undelivered or Unclaimed Goods

8.1 If a consignment cannot be delivered and remains uncollected beyond the agreed timeframe, CHS Transport will attempt to contact the Customer or Consignee. If no action is taken, the Carrier reserves the right to dispose of the goods by sale or destruction.

8.2 Any proceeds from the sale of undelivered goods will be used to cover outstanding charges. Any remaining balance may be returned to the Customer, thereby releasing CHS Transport from further liability.

9. Cancellation Policy

9.1 Cancellations within 30 minutes of scheduled collection from Inner London postcodes (EC1-4, WC1-2, W1, SW1, SE1) or within 60 minutes from any other location may incur charges up to the full cost of hire.

10. Charges & Payment Terms

10.1 Payment is due within 14 days from the invoice date unless otherwise agreed in writing.

10.2 Charges are based on CHS Transport’s current tariff at the time of service. Invoices are prepared at least monthly.

10.3 If a consignment is not ready at the agreed pickup time, or delays at the delivery location exceed 15 minutes, additional charges may apply.

10.4 Payments must be made in full without deductions. Late payments will be subject to 8% interest per day. Any invoice disputes must be raised within 7 days of the invoice date.

10.5 Weight-based charges apply based on the consignment’s gross weight, and volumetric pricing may be used where relevant. A fuel surcharge may also apply.

11. Liability for Loss or Damage

11.1 Unless otherwise agreed, CHS Transport’s liability is limited to:

  • The repair cost or replacement value of the goods (whichever is lower).
  • A maximum compensation amount of £2,500 GBP per consignment.

11.2 CHS Transport is not liable for loss, damage, or delay caused by:

  • Natural disasters or extreme weather (“Act of God”).
  • War, terrorism, civil unrest, strikes, or government action.
  • Seizure or forfeiture by authorities.
  • Customer error, mislabeling, insufficient packaging, or failure to collect goods.

11.3 Liability ends once transit is deemed complete.

12. Limitation of Liability

12.1 For non-consumable goods (e.g., documents, digital media), CHS Transport’s liability is limited to:

  • The material cost of lost/damaged records plus reasonable reinstatement costs.
  • £15 per kilo of lost/damaged items, whichever is lower.

12.2 CHS Transport is not responsible for indirect or consequential losses (e.g., lost profits, lost business, or missed deadlines).

13. Fraud

CHS Transport is not liable for any loss or damage related to fraudulent activity by the Customer, Consignee, or their agents unless directly caused by the Carrier’s employees.

14. Weight Accuracy

14.1 The Customer must ensure accurate weight declarations for consignments. If a vehicle is found to be overweight due to incorrect information provided by the Customer, the Customer will be liable for any resulting fines or penalties.
